Feds Lean On Stephon Mack Killing To Keep Lil Durk Locked Up As Bond Hearing Begins Today

Lil Durk’s freedom is on the line today — and federal prosecutors are pulling the most serious allegations in his remaining case into the fight to keep him locked up.

Durk — legal name Durk Banks — goes before U.S. District Judge Michael W. Fitzgerald today (November 4) at 2:30 p.m. Pacific for a bond review hearing in Los Angeles. His attorneys have asked the court to release him on a package secured by royalties and publishing income, with a Sony Music guarantee of up to $1 million reported in their October filing.

Prosecutors oppose his release, and their argument leans on the January 27, 2022 killing of Stephon Mack, who was shot outside the Youth Peace Center of Roseland in Chicago. In the government’s racketeering case, prosecutors allege Durk ran Only The Family as a criminal enterprise and offered money for the deaths of people connected to the Gangster Disciples after the June 2021 killing of his brother, Dontay “DThang” Banks Jr.

Two men — Anthony Montgomery-Wilson and Preston Powell — were charged federally with carrying out Mack’s killing in exchange for money, and both pleaded guilty to participating for promised payment. One fact matters for Durk’s side: neither man named Durk while entering his plea.

The context cuts both ways. In September, a federal jury acquitted Durk of all five charges in his first murder-for-hire trial, the case built around the 2022 Los Angeles attack targeting Quando Rondo. He has pleaded not guilty in this racketeering case and remains presumed innocent; that trial is currently set for August 2027.

Today’s ruling decides whether he waits for that trial at home or in custody, where he has been since October 2024. ITSBIZKIT will update this story when Judge Fitzgerald rules.
